A very efficient law firm handled my case efficiently and was always in contact with me. Jennifer Aguilar was very professional and kept me informed about the progress of my case. They resolved it in less than a year, and I had a check for my workers' compensation in hand. Highly recommended.

I had a very positive experience with my workers’ compensation attorney. From the beginning, they were professional, knowledgeable, and took the time to explain the process and answer my questions. They kept me informed throughout my case and made sure I understood what was happening every step of the way. I really appreciated how they listened to my concerns and worked hard to protect my rights and interests. Having someone experienced on my side made a stressful situation much easier to deal with. I would definitely recommend this attorney to anyone who is dealing with a workers’ union compensation case and needs someone they can trust.

The end result was solid, even though it took awhile to get there. My case worker, Sandra, was absolutely fantastic. She communicated well, was patient, and very kind and helpful. Definitely the best part of my experience. While I really only dealt with Roy Yang two times during the roughly 2 year process from start to finish, both times he was offputting and dismissive. His opening salvo the first time I spoke with him after signing up was basically "whatever your expectations are, lower them", which isn't really what one wants to hear from their attorney at the get-go. The 2nd time I spoke with him, we had a meeting regarding how to move forward with the case, which had basically been in limbo. I questioned why the associated costs of surgery weren't being picked up by the insurance company, to which he alarmingly answered "what surgery"? He then stated he had no information on that doctor's visit and summary, and I needed to call the doctor to get the proper records. I spent 3+ hours of my day off getting these records, signing release forms, and going back and forth with the doctor's office, only to find out that they had them the entire time. He just wasn't organized or prepared properly. He had no real plan to increase the C&R value of my case after the initial appraisal of my case was a low dollar value, as the insurance company had no interest in covering surgery for a C&R. I had to come up with my own plan to get the insurance company to cover the cost of surgery, which ended up working out, luckily. If I had just followed his lead and left him to his own devices, I would have ended up with about half of the value of what I ended up getting. I asked my case worker to just deal with her only from that point forward until we concluded the case. If it wasn't for Sandra and all of her hard work, this case likely wouldn't have gone well. I understand that in order for Workers Comp litigation to be profitable, that these firms need to take on a disproportinate amount of cases. A little more care and attention to detail from the actual lawyers would go a long way here, though. To the individual looking for representation, this is likely going to be their ONLY case dealing with Workers Comp, and it can be an important and life altering experience. The ONLY reason I'm not giving a lower score is due to Sandra and the rest of the office/case worker staff for going so far above and beyond my expectations. They, especially Sandra, were fantastic and really made the experience a positive one, despite my reservations about the attorneys.

What You Should Know About Workers’ Compensation in Stockton?

Workers’ compensation is designed to help employees who get hurt or sick due to their work duties.

Workers Compensation Lawyer

What Is Workers’ Compensation Under California Law?

Workers’ compensation provides timely assistance to injured or ill employees, covering medical expenses and lost wages so they can focus on recovery. It applies to a wide range of injuries, from acute physical harm caused by accidents to long-term health issues that develop over time due to workplace conditions.

What Does Workers’ Compensation Cover?

Workers’ compensation provides comprehensive support tailored to your unique circumstances. These benefits include:

Healthcare Benefits

Medical Treatment

Full coverage for medical treatments, including surgeries, hospital stays, prescription medications, physical therapy, and necessary equipment such as braces or wheelchairs.

Lost Wages

Temporary disability

Wage replacement benefits typically amount to two-thirds of your average weekly earnings, which can help during recovery.

Disability Benefits

Permanent disability

Financial aid for temporary or permanent disabilities that impair your ability to work, whether short-term or for the rest of your life.

Death Benefits

Death Benefits

For families who have lost a loved one to a work-related accident or illness, workers’ compensation covers funeral expenses and provides financial support for dependents.

Why Do You Need a Stockton Workers Compensation Lawyer?

While workers’ compensation is designed to help employees, the process isn’t always straightforward. Many workers encounter obstacles, such as denied claims, insufficient benefits, or uncooperative employers. A Stockton workers’ compensation lawyer can provide the guidance and advocacy you need to overcome these challenges.

The Workers’ Compensation Process in Stockton

Getting familiar with the workers’ compensation process can make you feel more prepared when managing your claim. While every case has its specifics, the following steps provide an overview.

  • Reporting the Injury: Notify your employer as soon as the injury happens. In California, this generally should be done within 30 days to maintain your right to benefits.
  • Filing a Claim: After reporting the injury, your employer will provide a DWC-1 Claim Form. Accurately filling out this form with details of the incident is essential to start your claim.
  • Medical Evaluation and Treatment: You’ll need to see an approved doctor for an initial examination. This evaluation helps determine the severity of your injury and the benefits you may receive.

Common Mistakes to Avoid When Filing a Claim

Filing a workers’ compensation claim is somewhat straightforward, but even small mistakes can jeopardize your chances of receiving the benefits you may be entitled to.

  • Delaying Reporting: You should notify your employer immediately after an accident to prevent complications or outright denial of your claim.

  • Incomplete or Incorrect Forms: The DWC-1 form, central to your claim, must be filled out thoroughly and accurately to avoid unnecessary delays.

  • Not Keeping Records: Many workers fail to maintain copies of vital documents, including medical reports, employer communications, and receipts related to their injuries.

  • Ignoring Deadlines: California law imposes strict time limits on various stages of the workers’ compensation process, and missing these deadlines could result in the forfeiture of your rights to benefits.

What to Do If the Claim is Denied?

A denied workers’ compensation claim can be alarming and feel like a significant setback, but it doesn’t have to be the end of the road.

  1. Review the Denial Letter: Sometimes, the denial is based on missing information or technicalities that can be resolved with additional documentation.
  2. Request a Reconsideration: You can file an Application for Adjudication of Claim to request a formal review.
  3. Seek Legal Help: Your attorney will help gather compelling evidence, prepare for court hearings, and advocate to ensure your rights are protected and your claim is reconsidered.

How Is the Payment Determined?

Workers’ compensation payments in Stockton are calculated based on your average weekly wage (AWW), which includes regular earnings, overtime, and specific benefits. For temporary disabilities, you’ll typically receive two-thirds of your AWW, subject to a maximum limit set by California law. These payments are designed to help cover lost wages during your recovery period.

For permanent injuries, the calculation becomes more complex. Its benefits depend on how severe your injury is and how long your injury impacts your ability to work. Age, occupation, and the extent of physical impairment determine the appropriate compensation.

Special Workers’ Compensation Situations

Workers’ compensation claims can sometimes involve unique or challenging situations. Here’s what you should know:

Workers’ Compensation for Work-Related Death

If a worker passes away due to a job-related injury or illness, their family or dependents may be eligible for death benefits. These benefits cover burial expenses and provide financial support to dependents who rely on the worker’s income.

Addressing Pre-Existing Conditions

Pre-existing conditions can complicate claims. However, if a workplace injury worsens an existing condition, you’re still entitled to compensation for the aggravated portion.

Handling Denied or Disputed Claims

You have the right to appeal if your claim is denied or disputed. Next steps may include providing additional documentation, requesting a QME/AME evaluation when applicable, and pursuing the WCAB process. If that doesn’t work, you can take your case to a Workers’ Compensation Appeals Board (WCAB) to resolve the issue.

Long-Term Disabilities and Illnesses

Workers’ compensation provides benefits for both temporary and permanent disabilities:

  • Temporary Disability: If you cannot work for a short period due to your injury, temporary disability benefits are designed to cover some of the lost wages until you recover and return to work.
  • Permanent Disability: This type of disability is categorized into two types:
    • Partial Permanent Disability: When the injury results in permanent limitations but doesn’t completely prevent you from working, you may receive partial permanent disability benefits.
    • Total Permanent Disability: If your injury permanently disables you from working, you may qualify for total permanent disability benefits.
