The end result was solid, even though it took awhile to get there. My case worker, Sandra, was absolutely fantastic. She communicated well, was patient, and very kind and helpful. Definitely the best part of my experience. While I really only dealt with Roy Yang two times during the roughly 2 year process from start to finish, both times he was offputting and dismissive. His opening salvo the first time I spoke with him after signing up was basically "whatever your expectations are, lower them", which isn't really what one wants to hear from their attorney at the get-go. The 2nd time I spoke with him, we had a meeting regarding how to move forward with the case, which had basically been in limbo. I questioned why the associated costs of surgery weren't being picked up by the insurance company, to which he alarmingly answered "what surgery"? He then stated he had no information on that doctor's visit and summary, and I needed to call the doctor to get the proper records. I spent 3+ hours of my day off getting these records, signing release forms, and going back and forth with the doctor's office, only to find out that they had them the entire time. He just wasn't organized or prepared properly. He had no real plan to increase the C&R value of my case after the initial appraisal of my case was a low dollar value, as the insurance company had no interest in covering surgery for a C&R. I had to come up with my own plan to get the insurance company to cover the cost of surgery, which ended up working out, luckily. If I had just followed his lead and left him to his own devices, I would have ended up with about half of the value of what I ended up getting. I asked my case worker to just deal with her only from that point forward until we concluded the case. If it wasn't for Sandra and all of her hard work, this case likely wouldn't have gone well. I understand that in order for Workers Comp litigation to be profitable, that these firms need to take on a disproportinate amount of cases. A little more care and attention to detail from the actual lawyers would go a long way here, though. To the individual looking for representation, this is likely going to be their ONLY case dealing with Workers Comp, and it can be an important and life altering experience. The ONLY reason I'm not giving a lower score is due to Sandra and the rest of the office/case worker staff for going so far above and beyond my expectations. They, especially Sandra, were fantastic and really made the experience a positive one, despite my reservations about the attorneys.Posted on Google![]()

They are handling my case, and at first I wasn’t feeling the communication at all. It felt nonexistent, but we had a sit-down and they explained how their office works. Understanding Workers' Compensation in Roseville
What Is Workers’ Compensation?
Workers’ compensation is a system that provides financial and medical benefits to employees who suffer injuries, illnesses, or trauma while on the job. It helps cover medical expenses and lost wages and supports recovery after an accident.
Eligibility for Workers’ Compensation
Employees working directly for a company are eligible for workers’ compensation benefits. However, independent contractors, visitors, volunteers, and business owners are generally not covered, even if injured at work.
Workers' Rights Under California Law
California law ensures workers’ rights in the event of a workplace injury or illness, including:
- Medical Benefits: Workers are entitled to necessary medical treatment for their injury or illness, with expenses covered by the employer.
- Lost Wages: If unable to work, workers should receive wage replacement benefits to compensate for lost income.
- Disability Benefits: For severe injuries requiring extended recovery, workers can access temporary or permanent disability benefits.
- Protection Against Retaliation: Employers cannot fire or discriminate against employees for filing a workers’ compensation claim.
Why You Need a Roseville Workers Compensation Lawyer?

Lawyers are the guides who help you navigate the most efficient path to your goal, making the journey smoother and less stressful. Here’s why you need a Roseville workers compensation lawyer:
Challenges in Filing a Claim
- Complex Paperwork: Completing and submitting forms that adhere to strict legal requirements can be difficult.
- Gathering Evidence: Collecting medical records, securing witness statements, and providing proof to support your claim is time-intensive and challenging.
- Injury Disputes: Facing claims that your injury was not work-related or was your fault can complicate the process.
- Claim Denials and Delays: Dealing with rejected claims or delays in processing can be frustrating and financially stressful.
- Employer Retaliation: The fear of unfair treatment or being fired for filing a claim can stop workers from pursuing their rights.
- Fair Compensation Calculation: Understanding what you’re entitled to and ensuring all areas of compensation are covered can be difficult without guidance.
How a Lawyer Can Help?
A Roseville workers’ compensation attorney will:
- Handle all paperwork and legal requirements.
- Manage disputes and protect your rights.
- Gather the necessary evidence to support your claim.
- Negotiate with employers or insurers for fair compensation.
Potential Obstacles Without Legal Support

- Claim Delays or Denials: Insurance companies or employers may delay or reject your claim.
- Low Settlement Offers: You may receive settlement amounts that don’t fairly cover your damages.
- Disputes Over Compensation: Employers or insurers may create disputes to avoid providing compensation.
- Paperwork Challenges: Managing complex paperwork and legal requirements can be overwhelming.

What Does Workers’ Comp Cover?
Health Care Benefits
As part of workers' compensation, all expenses related to medical treatment and recovery are covered, including hospital bills, doctor visits, surgeries, medications, and other necessary healthcare costs.
Lost Wages
If your injury prevents you from working, workers' compensation will provide wage replacement benefits to cover a portion of your lost income during your recovery.
Rehabilitation Cost
Workers' compensation covers additional treatments like physiotherapy your doctor recommends to aid recovery. It also includes rehabilitation services, such as vocational training, to help you find a suitable job after injury.
How Workers Compensation Covers Disability?
Temporary Disability
If an injury prevents you from performing your regular job and you lose wages during your recovery, you can receive Temporary Disability (TD) benefits, which are payments to cover this lost income.. Once you recover, you may return to your previous position if your doctor approves. If not, you may pursue a new job that aligns with your abilities and does not worsen your health condition.
Permanent Disability
If your injuries are severe and cannot fully heal, or if the recovery period is exceptionally long, workers' compensation provides permanent disability benefits. These benefits can include coverage for medical expenses, wage replacement, compensation for lost future earning capacity, and rehabilitation costs.
Special Cases in Workers Compensation
Claims for Fatal Workplace Accidents
Some fatal accidents that happen in the workplace result in death. In such cases, the family members ( spouse, minor & disabled children, and financial dependents), get compensated for the loss. They can get compensation for the lost source of income and funeral expenses.
Addressing Pre-Existing Medical Conditions
If you have pre-existing health conditions and an accident aggravates them, you must prove that the accident, not your past issues, caused the worsening of your health. It’s important to show that the new injuries are a direct result of the accident, not just a continuation of previous problems.
Overcoming Challenges in Denied Claims
Denied claims can be frustrating, but don’t give up on the compensation process. Consult a Roseville workers' compensation lawyer to identify the reasons for denial, such as insufficient evidence, delayed reporting, or disputes. They will address these issues, strengthen your case, and file an appeal to help you secure your compensation.

What Steps are Involved in the Workers' Compensation Process?
Various industries have unique risks for workers. Knowing common claims and how to file a workers’ compensation claim for injured workers seeking compensation is essential.
Filing a Claim After Workplace Injury
Reporting a workplace injury to your employer is essential and must be done immediately or within 30 days. The employer will provide you with a DWC-1 Claim Form to fill out, detailing the incident. Once completed, the employer will submit the form to the insurer. If you don’t receive any message, calls or emails from the employer or insurer within 90 days, your claim has been filed.

Important Deadlines
Be mindful of the deadlines: you must report the injury to your employer within 30 days of the accident. You have up to 1 year to file a legal claim. If your claim is denied, you only have 20 days to file a workers’ compensation appeal or refile the case.
Navigating Medical Evaluations
Prioritize your health and seek immediate medical attention from your preferred doctor. Don’t rely solely on the employer’s doctor, as they may downplay your condition. Ensure you get a thorough evaluation, and gather all medical records and bills as evidence for your case.
Resolving Disputes
Disputes may arise where the employer tries to blame you for the accident and claim the injury doesn’t warrant compensation. They might also attempt to terminate you without offering compensation. Avoid making statements that could be used against you—always consult with workcover compensation lawyers before settling.

Common Errors That Lead to Claim Denials
- Lack of evidence and witnesses to support the claim.
- Reporting the incident after the deadline.
- Incomplete or improper medical history.
- Not following the doctor’s recommended treatment plan.
- Disputes over the cause of the injury and inability to prove it as work-related.
How to Avoid These Mistakes
The solution to avoid these common mistakes includes:
- Reporting the incident to your employer immediately.
- Gathering evidence such as photos, videos, and witness statements.
- Seeking medical treatment and collecting your medical history as evidence.
- Consulting a California workers’ comp attorney before filing a claim and completing all necessary paperwork.
